Many common arrangements between hospitals and their medical staff members continue to raise compliance questions under the federal physician self-referral law, federal anti-kickback law, and other health care fraud and abuse laws. These include offering medical staff physicians business courtesies, free continuing medical education, professional courtesy, and physician recruitment incentives. Recent guidance by the federal government failed to provide definitive answers as to how such practices would be viewed. Given the frequency with which these practices are considered and the potential legal criminal, civil, and administrative penalties if the law is violated, greater clarification is needed. Our speaker will review the compliance concerns associated with each of the foregoing practices and describe how hospitals can best reduce their risk when considering whether to engage in such activities.
