The session builds upon the detailed review, in session one, of the advisory opinions on gainsharing recently issued by the Department of Health and Human Services Office of Inspector General (?OIG?). In this second session, participants will draw upon the recent advisory opinions and lessons learned from collaborating with the OIG in the advisory opinion process to identify key elements that should be a part of any gainsharing arrangements. The impact of gainsharing under the Stark Law and restrictions on the operation of tax exempt hospitals will also be addressed. Remaining areas of regulatory uncertainty will be identified. Use of the OIG advisory opinion process to vet gainsharing arrangements will also be referenced
